01Agreement to These Terms
These Terms of Service (the “Terms”) form a legal agreement between you and DevSoft Studio (“DevSoft Studio,” “we,” “us,” or “our”) concerning our mobile games, applications, websites, web applications, software, content, community features, support, and related services (collectively, the “Services”).
By installing, accessing, purchasing through, or using a Service, you confirm that you have read and agree to these Terms and our Privacy Policy. If you use a Service on behalf of an organization, you represent that you have authority to bind it.
02About DevSoft Studio
DevSoft Studio is a Pakistan-based technology company that develops and publishes games, mobile applications, web applications, and software. Our official contact information appears in Section 23.
These Terms apply to Services offered under the DevSoft Studio name and to any Service that links to these Terms.
03Eligibility and Minors
You must be legally capable of entering into these Terms. If you are below the age of legal majority where you live, a parent or legal guardian must review and agree to these Terms and supervise your use.
Unless a Service specifically says otherwise, our Services are general-audience and are not directed to children under 13. Age limits, parental-consent rules, and platform family policies may vary by country and Service. You must provide accurate age information where requested.
04Accounts and Security
Some Services may allow or require an account. You agree to provide accurate information, keep login credentials confidential, and promptly notify us of suspected unauthorized use. You are responsible for activity through your account to the extent permitted by law.
You may not sell, rent, transfer, share, or provide another person access to an account unless the Service expressly permits it. We may require verification to recover, modify, or delete an account.
05Limited License
Subject to these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable, and non-sublicensable license to install and use the applicable Service on devices you own or control, solely for lawful, non-commercial entertainment or the intended business function of the Service.
The Services are licensed, not sold. We and our licensors retain all rights not expressly granted. You may not use the Services to build or assist a competing product.
06Acceptable Use and Fair Play
You must not:
- cheat, exploit bugs, use bots, scripts, automation, mods, hacks, emulators intended to gain an unfair advantage, or unauthorized third-party software;
- reverse engineer, decompile, disassemble, copy, scrape, extract, alter, or create derivative works except where applicable law expressly permits;
- circumvent security, access controls, age gates, geographic restrictions, or technical limitations;
- access another user's account or our systems without authorization;
- upload malware, harmful code, or content designed to disrupt a Service;
- harass, threaten, bully, stalk, impersonate, defraud, or expose another person's private information;
- post unlawful, hateful, sexually explicit, exploitative, infringing, deceptive, or abusive content;
- spam, manipulate rankings or reviews, conduct unauthorized advertising, or disrupt communities;
- buy, sell, trade, or transfer accounts or Virtual Items outside methods we expressly authorize; or
- use a Service in violation of law, sanctions, export restrictions, third-party rights, or these Terms.
We may investigate suspected violations and take proportionate action, including warnings, feature restrictions, removal of content, suspension, or termination.
07User Content and Conduct
“User Content” means content you submit through a Service, such as usernames, messages, images, feedback, or files. You retain ownership of your User Content.
You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, adapt, and distribute User Content only as reasonably necessary to operate, secure, improve, and promote the relevant Service, subject to our Privacy Policy. This license ends when the content is deleted from active systems, except for lawful retention, backups, or content shared with others that they retain.
You represent that you have the rights needed to submit User Content. We may moderate or remove content, but we do not guarantee that all content will be reviewed.
08Virtual Currency and Items
A Service may include virtual currency, points, lives, boosters, skins, or other digital items (“Virtual Items”). Virtual Items are licensed for use only within the applicable Service. They:
- have no cash value and are not legal tender, stored value, or financial instruments;
- cannot be redeemed for money or transferred outside authorized Service features;
- may be modified, limited, or discontinued for gameplay, security, legal, or technical reasons; and
- may be lost when an account is terminated for a material violation, subject to applicable law.
Virtual Items may not be used for wagering or to win real-world money or prizes unless a clearly identified, separately regulated feature expressly permits it. We will not intentionally remove paid Virtual Items without a legitimate reason. Mandatory refund and consumer rights remain unaffected.
09Purchases, Pricing, and Taxes
Purchases may be processed by Apple App Store, Google Play, another platform, or an authorized payment provider. Their payment terms also apply. Prices, currencies, taxes, and available products may vary by region and platform.
You authorize the applicable provider to charge your selected payment method. You are responsible for applicable taxes and third-party data or carrier charges. Do not make a purchase unless you are authorized to use the payment method.
Except where law or the platform's refund rules require otherwise, digital-content sales are final after delivery. Refund requests for app-store purchases should generally be submitted to the store that processed the transaction. Contact us if content was not delivered so we can investigate.
10Subscriptions and Trials
If a Service offers a subscription, the price, billing period, benefits, renewal terms, and any trial conditions will be shown before purchase. Unless stated otherwise, subscriptions automatically renew until canceled through the platform or account used to subscribe.
Cancel before the renewal deadline shown by the provider to avoid the next charge. Deleting the app does not cancel a subscription. Access normally continues until the end of the paid period. Renewal, cancellation, and refund rights remain subject to applicable law and platform rules.
11Advertising and Promotions
Some Services display advertising or offer rewarded ads. Availability and rewards may depend on successful completion and technical verification. Ads are supplied partly by third parties, and their products, claims, and destinations are their responsibility.
Promotions, contests, or events may have additional official rules. If those rules conflict with these Terms for that promotion, the specific rules control.
12Third-Party Services and Links
Services may integrate app stores, social networks, advertisements, analytics, authentication, payment services, or external links. Third parties operate under their own terms and privacy policies. We are not responsible for independent third-party services, but this does not limit responsibility that cannot legally be excluded.
13Updates and Service Changes
We may update Services to add features, fix defects, rebalance gameplay, improve security, comply with law, or maintain compatibility. Some updates may be required to continue using a Service.
We may change, suspend, or discontinue all or part of a Service. Where reasonably practical and legally required, we will provide notice of material changes. Online features may experience maintenance, outages, or technical interruptions.
14Intellectual Property
The Services—including software, code, game mechanics as protectable, artwork, characters, graphics, audio, text, logos, trademarks, interfaces, databases, and other content—are owned by or licensed to DevSoft Studio and protected by applicable intellectual-property laws.
No right to use our names, logos, trademarks, or content is granted except for the limited Service license in Section 5 or written permission.
15Copyright and Rights Complaints
If you believe content in a Service infringes your copyright or other rights, email ceo@devsoftstudio.com with: your contact details; identification of the protected work; the exact location of the material; a good-faith explanation; a statement that the information is accurate and that you are authorized to act; and your physical or electronic signature.
We may request more information and may remove or restrict disputed material while reviewing a complete notice. Knowingly submitting a false complaint may create legal liability.
16Feedback
If you voluntarily provide ideas or suggestions, you grant us a worldwide, perpetual, irrevocable, non-exclusive, royalty-free right to use them without compensation or obligation, provided we do not publicly identify you without permission. Do not submit confidential material as feedback.
17Suspension and Termination
You may stop using a Service at any time. Where an account exists, you may request deletion as described in our Privacy Policy.
We may suspend or terminate access when reasonably necessary because of a material or repeated breach, fraud, cheating, security risk, legal requirement, non-payment, harm to users, or discontinuation of a Service. When appropriate, we may give notice and an opportunity to correct the issue. Immediate action may be necessary for serious violations or security threats.
Provisions that logically survive termination—including ownership, payment obligations, disclaimers, liability limits, dispute terms, and accrued rights—will continue.
18Service Disclaimers
To the maximum extent permitted by law, Services are provided “as is” and “as available.” We do not promise uninterrupted, error-free, completely secure, or universally compatible operation, or that content and features will always remain available.
Health and safety
Use games responsibly, take reasonable breaks, and follow device safety guidance. A small number of people may experience seizures or discomfort from flashing lights or visual patterns. Stop using the Service and seek appropriate medical advice if you experience symptoms. Do not play while driving or where distraction could create danger.
Nothing in these Terms excludes warranties, remedies, or consumer rights that cannot lawfully be excluded. Some jurisdictions do not permit certain warranty exclusions, so parts of this section may not apply to you.
19Limitation of Liability
To the maximum extent permitted by law, DevSoft Studio and its affiliates, personnel, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of profits, revenue, data, goodwill, or business opportunity arising from the Services.
Where liability may lawfully be limited, our total liability for claims relating to a Service will not exceed the greater of (a) the amount you paid us for that Service during the 12 months before the event giving rise to the claim or (b) USD 100.
This limitation does not apply to fraud, willful misconduct, death or personal injury caused by negligence, or any liability or remedy that applicable law does not permit us to exclude or limit.
20Indemnity
To the extent permitted by law, you agree to indemnify DevSoft Studio against third-party claims, losses, and reasonable costs arising from your unlawful User Content, your material violation of these Terms, or your infringement of another person's rights. This does not require you to indemnify us for our own negligence, misconduct, or legal violation. We will provide reasonable notice and allow your participation in the defense where appropriate.
21Governing Law and Disputes
These Terms are governed by the laws of Pakistan, without regard to conflict-of-law rules. Subject to mandatory consumer law and any court that must legally hear a dispute, the courts with jurisdiction in Islamabad, Pakistan will have exclusive jurisdiction.
Before filing a formal claim, you and DevSoft Studio agree to make a good-faith attempt to resolve the dispute by written notice and allow 30 days for a response. This informal step does not prevent either party from seeking urgent injunctive relief or using a small-claims or consumer forum where available.
Consumer protection: If you are a consumer, you retain mandatory rights and may be entitled to bring a claim in your home jurisdiction. Nothing here deprives you of protections that cannot be waived by contract.
22Changes and General Terms
Changes to these Terms
We may update these Terms for changes in Services, law, security, or business practices. We will update the “Last updated” date and provide additional notice of material changes where required. Continued use after the effective date constitutes acceptance where permitted by law; otherwise we will request consent when required.
Entire agreement
These Terms, our Privacy Policy, and any Service-specific terms form the agreement between you and us concerning the Services.
Severability and waiver
If a provision is unenforceable, it will be limited or removed only to the minimum necessary, and the remainder will continue. Failure to enforce a provision is not a waiver.
Assignment
You may not transfer these Terms without our consent. We may transfer them as part of a merger, acquisition, restructuring, or asset transfer, subject to applicable law and notice requirements.
Events outside reasonable control
We are not responsible for delay or failure caused by events beyond our reasonable control, such as natural disasters, war, civil disorder, labor disputes, internet or utility failures, government action, cyberattacks, or platform outages, except where applicable law provides otherwise.
No third-party beneficiaries
Except for platform-specific beneficiaries described below, these Terms do not create rights for third parties.
Apple-specific terms
If you obtained an iOS Service through Apple, these Terms are between you and DevSoft Studio, not Apple. The license is limited to use on Apple-branded products you own or control as permitted by Apple's Usage Rules, including permitted Family Sharing or volume-purchase use. Apple has no obligation to provide maintenance or support.
If the application fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any, as required by its rules. To the maximum extent permitted by law, Apple has no other warranty obligation. DevSoft Studio—not Apple—is responsible for addressing claims about the application, including product-liability, legal-compliance, consumer-protection, and intellectual-property claims. You represent that you are not located in a country subject to a U.S. government embargo and are not listed on a prohibited or restricted-party list. Apple and its subsidiaries are third-party beneficiaries of these app-license terms and may enforce them.
